Organisation of the membership commission and membership procedure

SECTION 1 : MEMBERSHIP OF THE ASSOCIATION
The Association has two categories of members : Statutory members and Associate members.
Membership as a Statutory member includes commitments that are not applicable for Associate members; the admission criteria and formalities for Associate members have been simplified.

A | Criteria for admission
These are of three types: a) Experience and certified qualification in an area of corporate management ;

b) A confirmed ability for handling and mastering the three aspects of court appointed expertise : Expert appraisal meeting, case analysis, report writing ;

c) A desire to play an active personal role within the Association, by taking part in its activities : working groups, organisation of events, the compilation of documents, etc.

d) For Associate members, the desire to achieve an appropriate level of competence in terms of expertise procedures and methodologies.

The purpose of the membership procedure is to establish between the expert and the members of the Committee a close relationship to avoid any ambiguity, and thus any misunderstanding, especially in terms of the third criteria.

B | Formalities
Experts wishing to join the Association must complete an application form.
For applicants for Statutory membership, a recent expert case study is included, which will be kept confidential.
For both candidate categories, and in accordance with Article 5 of the Articles of Association, the Committee carries out a secret ballot on admission, without having to disclose the reasons for its decision.

C | File for membership
The membership application file includes the following documents : For Honorary members :
- a membership application ;
- biographic résumé.

For Associate members, in addition :
- a brief analysis in a few lines of the most significant management expertise cases, for each one clearly highlighting :
- the real economic content of the case (and not the terms that could have been contained in the order to appoint the expert);
- the critical element in the case, i.e. the technical problem with the solution that was prior to the legal action, and necessitated recourse to an expert.

The last two documents below can be used in the publications of the Association :
- a photocopy of the report on current and completed cases, such as that drawn up every year for the Court of Appeal expert department, and covering three years ;
- in strict confidentiality, a recent case report, carried out fully and exclusively by the expert.

Section 2 : other PROVISIONS
Members are prohibited from stating their membership of the Association on their business documents such as letter head, business cards, etc., as well as on all documents used in the context of an expert mission.
The quarterly training meetings held by the Association are intended to develop the quality of expertise of the members through the sharing of knowledge and practical analyses carried out jointly. These discussions are subject to absolute confidentiality. They do not in any way represent the position of the Association on any of the subjects discussed and only the President in office can issue or state an opinion or recommendation on behalf of the Association.
Any breach of this rule of absolute confidentiality will result in such measures as shall be decided by the Committee and can include the expulsion of a member.
All members of the Association must behave in an ethical and professional manner in all relations with constituted bodies and with other experts.

Section 3
a) The fees payable to the Association will be divided into three parts, one corresponding with the membership fee as a contribution to the association, and the other as a contribution to the costs involved in providing training such as that provided by the Association through its seminars and the last one is representing the cost of the compulsory group professionnal liability insurance.

b) Members will receive a statement from the Association, in the 6 weeks following the end of each year, which will show the amount of this contribution to training costs and their presence at the various seminars organised by the Association.

c) The professional liability insurance policy that has been taken out by the Association is mandatory and is added to the membership fees.
